Probate Administration
I’m The Personal Representative. What Do I Have To Do?
In Probate Administration, as personal representative you are responsible for the entire administration of the deceased’s estate. This involves many steps, including:
- Identifying, notifying and paying estate creditors
- Identifying and notifying estate heirs and beneficiaries
- Locating and valuing the estate’s assets
- Finding any estate planning documents, such as a will, and submitting them to probate court
- Funding any trusts
- Selling real estate, if necessary
- Distributing assets, money, and real property to the estate’s heirs
We are Here to Help
The burden of probate administration can seem very overwhelming, especially because the death of a loved one is an emotional and stressful time in and of itself. Being named personal representative, or executor, of your loved one’s estate, is a large responsibility but the good news is that we are here to help.
At Terrazas Henkel, P.C., our probate administration attorneys can offer as much or as little support as you need during the probate process.
Many of our clients prefer to hand the entire administration of an estate over to our team. Others want guidance and direction on a few essential items, but prefer to handle the bulk of the probate process on their own.
No matter what your needs, we are here for you. Our goal is to take some of the burdens off of your shoulders so you can focus on the grieving process and honoring the life of your loved one.
If a loved one passed away without an estate plan, you would have to petition to be named as personal representative. Our lawyers are well-versed in this and can assist you with the process.
What If Disputes Arise?
This can be common during probate — especially if someone passes away without a will. While he or she may have made verbal promises to various family members, unless they are in writing, they are difficult to prove. Even if there is a will, family members can contest its validity.
